According to a report from the Associated Press, Activision claims that Double Fine failed to deliver Brütal Legend on time and mostly on its dime. The suit contends that the Brütal Legend dev was paid $15 million to finish the game, but missed a key deadline, with Double Fine asking for another $7 million in development monies and a nine month extension.
                      When Vivendi and Activision merged last year, Brütal Legend was missing from the list of titles that Activision would inherit and publish. But Activision claims it still retains its rights to the open world action adventure and that the mega-publisher has suffered "irreparable harm" in losing the game.
 The lawsuit is unlikely a surprise for EA and Double Fine, as Activision expressed its unhappiness with the game being handed over to its biggest competitor earlier this year. EA's response to Activision's legal threats called them as ridiculous as "a husband abandoning his family and then suing after his wife meets a better looking guy."
 Brütal Legend's presence at E3 2009 is big. New publisher Electronic Arts is banking heavily on the game, but if Activision is successful in its latest round of litigation, it's possible that we might have to start looking forward to a Rockvember or Rockcember release.

This is a legal move but it is still a fucking puss, Activision layed down the project out of their reach because they thought it would be not "worth exploding", so if they kicked it away its their own fucking fault.

I hope Activision's booth gets wrecked as the E3 is still up.

This is a beat em' up, right? Yeah, I've always hated those, even Devil May Cry and God of War seemed too repetitive and HARDCEOR for my taste. I don't know, there are only SO MANY times I can push circle to watch something die before it gets dull.

Yeah beat em ups are boring but so are RPGs and first person shooters and almost every game in the world. The fact of the matter is that almost every game is exactly the same and the only thing that makes most of them worth playing is the story because the fun of the gameplay almost always gets dull after about an hour. Tim Schafer is awesome at writing and unless Jack Black fucks it up horrifically the game will be funny and have a good story and that will make it worth playing.

He should seriously go back to making proper adventure games though.

Probably, but who cares? Alot of games are shitty in their gameplay etc. but the story/mode is so cool you just have to keep playing;

Heroes of Might and Magic 4 sucked compared to the old ones but the stories were fucking epic: Like Oscar movies turned into games.

They dumped Brutal Legend because it didn't seem to have that characteristic, and it wasn't even Activision who gave the initial budget, Vivendi was still independent when they launched the moves but Activision legally has the rights now they absorbed Vivendi, but they really didn't give any profit or even interest under the Activision name.

two entirely different synerious, actually:

Activision actually put a good 30 million(or something like that, i can't remember the exact details) into Brütal Legend then dropped the project claiming it was going nowhere. Now they're sour that it's a good game and they're out the money.
TakeTwo never provided any money for Duke Nukem Forever (aside from the money they paid to purchase the publishing rights from ATARI, and none of that money went to 3DR) because 3Drealms was entirely self funded. The TakeTwo lawsuit is essentially a scare tactic to get the developing rights for Duke Nukem Forever.

Actually it's a lot of fun and I've seen plenty of people have fun with it.  It's a pretty good party game.
Rock Band's even more fun because you have four people playing at once all working together and usually all making fools of themselves.

Guitar Hero isn't something I would call bad, but it's certainly not for everyone. I personally find it to be lacking since I see it as a much less energetic form of DDR. That only makes it a bad game for me, but most other people have no problem with it.

But really, the main issue is that it's becoming the new EA Sports. Activision is just re-releasing it over and over again with new tracks. It would be easier to release DLCs to get new songs and features, but they'll never do that because they're earning much more money this way.

This alienates real game developers. Publishers spend way too much money at churning out more sequels, so other development teams aren't getting enough funds for newer, more exciting games. And then they throw a humongous "fuck you" at the developers by paving over all of their previous work to make way for more sequels.

I actually think the set list for Guitar Hero 3 was pretty good, I have a problem with the game itself.  With Guitar Hero 1, the game had some difficulty, but it was still possible and very fun on Expert mode.  With Guitar Hero 2, the songs got harder, but that was okay since they made the hammer-on and hammer-off system good, so the game was still fun.

However, with Guitar Hero 3, the notes are just all over the place, triplets everywhere, and you had Through The Fire and Flames, which was a shit song in the first place, but then I heard it 2486724y87 more times when the game came out, and the song wasn't that fun to play.  "Oh boy, I get to fail a song within 3 seconds!  What a fun game!"

Now, granted, Jordan was a fucking impossible song on Guitar Hero 2, but it was one exception, the rest were still fun and possible songs to beat.  Jordan is like that one optional boss whose stats are fucked and kills you with one special movie.

But with Guitar Hero 3, I couldn't help but get the feeling that Activision saw how much people were talking about (how impossible) Jordan (was) and thought "Hey, if people likes Jordan, then they're going to love it when EVERY SONG IS A GIANT MASS OF BUTTONS".

tldr; Guitar Hero 3's songs are good but the notes are fucking impossible and shit and not fun.

Oh god, OH GOD. That's cool and all, but the setup makes it look like they're gonna end the game with the "HE WAKES UP AND FINDS OUT IT WAS ALL A DREAM OR WAS IT" trope.

Double Fine doesn't seem like the kind of company that would pull that, but I will be PISSED if they do.

I was thinking about that too, but the whole scene with the metal fiend bashing the shit out of the hipsters seemed too canonical to not be right.
 
Still, I wouldn't give two shits about the conclusion, the whole game is going to be super awesome. Maybe even they are teasing that scene just to give us an unexpected ending when we thought it wouild be predictable. Schafer knows the industry very well.
