I get that the CC isn't a collective lol, but I've always wondered what the kind of general consensus here on selling CC projects is. I know that for Strange Clock's cancelled "Darkest:Hour" project, he intended to sell it on DVD when it was finished, which I can assume he wasn't gonna be doing for free lmao. Has anyone ever sold a CC project in the past?

from what I know of intellectual property law, that'd actually be a really interesting problem if you wanted to do it all above board, because, no one individual owns the copyright to the full breadth of what the clock crew is, but that's not the same as it being free of license

because if you build something on top of somebody else's copyright, you own the rights to everything new that you added, but the copyright holder maintains the original copyright. and it's considered natural and assumed; you don't have to register it or anything

so let's say you wanted to sell something that included, for instance, me, SkurpeeClock
I own the copyright to the character of SlurpeeClock
but 7-Eleven, Inc. owns the copyright to Slurpees
and you would need both mine and 7-11's permission to use the character
but also, the SlurpeeClock character is derived from the Clock Crew, which was created by OrangeClock, making him a potential litigant, and the Clock Crew was arguably derivative of the persona of StrawberryClock, making him a potential litigant
and on top of that, even the concept of depicting members of the Clock Crew as sapient objects with clocks on them,is a copyrightable concept, and I have no idea who originated that (and that's coming from a dude who was pretty obsessed with this stuff back in the day)

what I can tell you for sure was there were some now-very-strange ideas of how to depict clocks before the concept solidified into what most of us are familiar with



and I have no idea who was the first to do it the way we do it now

people who were around back then might remember, but afaik no efforts to document early clock stuff bothered to delineate who was responsible for what

the coalescing of the concept of what the clock crew is happened in a flurry of both collaborative and competitive creativity across a few weeks or months in the second half of 2001, mostly by minors, possibly from different countries, posting pseudonymously, and a few of whom have since died or faked their deaths (all of which also does not nullify the copyright, but does make it harder to find out who holds it)

if somebody, let's say netflix, wanted to start making money off of the clock crew — or just one of us did but it turned out to be really lucrative and we started suing each other
— attorneys would probably have to sort through not just scores of early flash movies to prove the origin of certain concepts, but they might even have to subpoena newgrounds for ones that were blammed or have since been removed, and that'd be just to start with, because there was also a lot going on on the newgrounds bbs at the time, and other places on the old web that I don't think have been preserved for posterity over the last 20+ years
which is not even to mention how gleefully and without citation we've traditionally stolen concepts from, just, whatever we find funny (sulkoma, eskimo bob, the creator of "WHY???", dril) and how much of that was obvious at the time but has pretty much faded from memory, along with how much stemmed from inside jokes of frankly unclear and potentially bizarre origin (dark symphony rpg)

you could potentially have a case that the clock crew qualifies as a genre, which protects most of its tropes as fair use and not copyrightable, but I don't know the strict legal definition of genre and I doubt there'd be a lot of legal precedent because we're a really fucking weird case, even for the internet


tl;dr it seems to me it would be prohibitively expensive to do without potentially violating somebody's copyrights
but also... nobody's ever been sued
but also that doesn't mean they couldn't, because, there's also never been good reason to, because nobody's done it before
but also (this is not an advisory statement I am merely opining) I really doubt anybody would care enough to press charges. this is all just me speculating. if you were disney or illwillpress, we might get up in arms about it and lawyer up, but if you're one of the gang just trying to make a buck for yourself off your own hard work, I would assume most of us would just respect the hustle

I've actually never seen those other ways of portraying clocks before, I suppose before KBM's icon was Strawberry Clock in the we know it now they just had to guess off of the name. I wonder if Strange Clock thought about all this back in 2007, because from what I can gather off of whats available of Darkest:Hour, the only actual clock in it (based off a user), is Strawberry.

It'd be cool if we still had merch of the CC, if there was like a white t shirt with the NG tankman CC variant thing I'd buy that shit immediately lol it'd look so pimpin

I was thinking about this because I wanna put Clocktopia up on Steam when it's done hopefully, but I think the game not only featuring lots of licensed brands (Slurpee like you said, or D.Va Clock and all the rest), but also featuring the artwork of other artists, and some music from other people, on-top of all the voice-acting, it'd be a nightmare to make sure everyone gets paid for something I'd probably only be selling for like £1.99. You can put stuff on Steam for free though, so maybe I should just cobble together the distribution fees myself haha

All in all I think it's time commercialise the Clock Crew and split the profits evenly across all members who have ever joined lmao
