Honestly I'm kinda one to uphold separation of church and state guys, it'd really help my cause of being indifferent to it if you guys weren't dicks about the religion thing.

Oh, probably. I haven't read much about it but I don't think it was a Supreme Court decision, so yeah if someone's panties are in a bunch about it enough it very well may.

And Marlin, I haven't seen too much of this religious dickishness but I call myself a Christian also. But I think in this day and age there's just some shit in the Bible one has to acknowledge is not the word of God (a lot of old testament ish, like if your daughter is raped she is to marry the rapist and such).

from what i understand, the federal judge that issued the ruling immediately issued a stay, as well, which means that it's gonna be up for appeal sometime

the interesting part, though, is that the judge's ruling was pretty airtight and one of the big precedents that the attorneys on the winning side used was... a scalia decision

so if it gets to the supreme court (it probably won't) don't expect anything big there

next stop is the 9th circuit court of appeals, if that.
afaik the state refused to defend the proposition in court, so they ended up getting a bunch of shitheads defending it that might not even have the legal footing to be able to make a proper appeal. Judge Walker also kicked the living shit out of it in the decision- it's packed with copious citations of precedent, and basically shits all over prop 8 so hard it doesn't even look like it has a leg to feebly wiggle in impotent rage, much less stand on. reexamining his decision means reexamining his citations, which is a comparatively huge pain in the ass, and he actually ruled that ruling based on sexual orientation should universally be held under strict scrutiny, but that prop 8 fails to even make it that far, because it doesn't even survive rational basis review.
and scotus might not even want to touch it, because if they take it out of the 9th district, they'd have to defeat it more soundly than it's likely possible to do just to not have some repercussions trickling through the entire union.

this is all hearsay, but yeah. everything I've read shows Walker crushing this motherfucker like the fist of an angry god.
